Partner Terms and Conditions

Welcome to the MannVahan Partner Programme. These Terms and Conditions ("Terms") govern your participation as an independent partner driver on the MannVahan platform. By registering as a partner, completing the onboarding process, or accepting ride requests, you agree to be bound by these Terms.

1. About MannVahan

MannVahan is a technology-based ride-hailing platform that connects independent partner drivers with riders seeking bike and auto-rickshaw rides across Maharashtra. MannVahan earns a platform fee and service charge on completed rides, which are charged to the rider on top of the partner's fare; it does not employ drivers or own vehicles.

2. Partner Eligibility & Onboarding

To register as a MannVahan partner you must:

• Be at least 18 years of age and hold a valid driving licence for the vehicle category you intend to use.
• Own or have lawful possession of a vehicle that meets MannVahan's vehicle standards.
• Provide a valid Aadhaar card, PAN card, vehicle registration certificate (RC), vehicle insurance, and any other documents requested during onboarding.
• Pass MannVahan's background verification process.
• Have a working Android smartphone capable of running the MannVahan Partner App.
• Have an active bank account for earnings settlement.

3. Vehicle Standards

• Your vehicle must be roadworthy, legally registered, and insured at all times.
• Bike partners must operate two-wheelers with a valid commercial/white-board registration as required by local transport regulations.
• Auto partners must hold a valid commercial permit for their auto-rickshaw.
• The vehicle must be clean, well-maintained, and free from any modifications that could endanger rider safety.
• MannVahan reserves the right to inspect your vehicle and suspend your account if the vehicle does not meet required standards.

4. Account Registration & Security

• Register using your valid mobile number. One partner account is permitted per person.
• Keep your login credentials confidential. You are responsible for all activity under your account.
• Notify us immediately at support@mannvahan.in if you suspect unauthorised access.
• Sharing your account credentials or allowing another person to accept rides using your account is strictly prohibited and will result in permanent deactivation.

5. Accepting & Completing Rides

• You are free to go online or offline at any time. MannVahan does not mandate minimum hours or availability.
• Once you accept a ride request, you must proceed to the pick-up location without unnecessary delay.
• Do not cancel accepted trips without a genuine reason. Excessive or selective cancellations may result in reduced trip allocation or account suspension.
• Always follow the app-provided route, or obtain the rider's explicit consent before taking an alternate route.
• Verify the rider's name or OTP (if applicable) before starting the trip.
• End the trip in the app immediately upon drop-off at the correct destination.

6. Fares & Earnings

• For each completed ride you are paid according to the partner rate card shown in the Partner App, based on distance, pickup distance, waiting time and time-of-day (night) rates. MannVahan may revise the rate card at any time; a ride is paid at the rate card in force when it was booked.
• MannVahan does not deduct a commission from your rate-card earnings. The rider pays a platform fee and service charge on top of your fare; these belong to MannVahan.
• Riders usually pay you in cash at the end of the ride. Because that cash includes MannVahan's platform fee and service charge, and because amounts may also be owed to you (for example, rewards), these are recorded in your partner wallet and settled weekly. A negative wallet balance must be paid to MannVahan; amounts owed to you are paid to your registered bank account.
• You are responsible for all taxes (including income tax and GST, if applicable) on your earnings. MannVahan may issue TDS certificates as required by law.
• Attempting to manipulate fares, routes, or the GPS system to inflate earnings is a serious violation and will result in immediate deactivation and potential legal action.

7. Partner Conduct & Professionalism

• Treat all riders with courtesy, respect, and professionalism regardless of gender, religion, caste, or background.
• Do not use abusive, threatening, or discriminatory language or behaviour toward riders.
• Do not ask riders for personal contact information or attempt to solicit off-platform bookings.
• Do not refuse rides based on a rider's destination, gender, or background.
• Do not use the vehicle for any purpose other than completing rides assigned through the MannVahan platform while you are on-duty.
• Maintain personal hygiene and ensure the vehicle is clean before going online.

8. Safety Obligations

• Comply with all applicable traffic laws, speed limits, and road safety regulations at all times.
• Do not drive under the influence of alcohol, drugs, or any substance that impairs judgment.
• Ensure all riders wear helmets (bike) or seat belts (auto, if applicable) as required by law.
• Do not use a mobile phone while driving except via a hands-free device.
• In the event of an accident, follow the prescribed emergency procedure: ensure rider safety, call emergency services if needed, and notify MannVahan support immediately.
• MannVahan may suspend your account pending investigation following any safety-related incident.

9. Ratings & Performance Standards

• Riders may rate you after each completed trip. Your average rating is visible in the Partner App.
• MannVahan may set a minimum rating threshold. Consistently falling below this threshold may result in reduced ride allocation, retraining, or account suspension.
• Do not solicit or coerce riders for higher ratings.
• Fraudulent manipulation of ratings is prohibited.

10. Incentives & Bonuses

• MannVahan may offer performance incentives, trip bonuses, and promotional rewards subject to their individual terms and validity periods.
• Manipulating the system to qualify for incentives (e.g., fake trips, GPS spoofing) is a serious violation and will result in deactivation and recovery of fraudulently claimed amounts.
• MannVahan may modify, suspend, or terminate any incentive programme at any time.

11. Background Location & Data

The MannVahan Partner App collects your device location in the background while you are online to enable ride matching, trip tracking, and safety features. By accepting these Terms, you consent to this data collection as further described in the Partner Privacy Policy.

12. Insurance & Liability

• You must maintain valid vehicle insurance as required by the Motor Vehicles Act at all times.
• MannVahan is not responsible for accidents, injuries, property damage, or third-party claims arising from your operation of the vehicle.
• You agree to indemnify MannVahan against any claims arising from your actions as a partner driver.

13. Intellectual Property

All trademarks, logos, and content on the MannVahan platform are owned by or licensed to MannVahan. You may not use the MannVahan name, logo, or branding for any purpose other than identifying yourself as an active MannVahan partner driver.

14. Confidentiality

You must keep confidential any proprietary information, pricing models, or operational data you access as a MannVahan partner. This obligation survives termination of your partnership.

15. Suspension & Deactivation

• MannVahan may temporarily suspend your account pending investigation of complaints, safety incidents, or policy violations.
• MannVahan may permanently deactivate your account for serious violations including fraud, harassment of riders, document forgery, DUI, criminal charges, or repeated policy breaches.
• You will be notified of the reason for suspension/deactivation where legally permissible.
• You may voluntarily exit the partner programme at any time by contacting support; your partner wallet will be settled in the next weekly settlement.

16. Limitation of Liability

• MannVahan's aggregate liability to you for any claim shall not exceed the total service fees earned by you in the 30 days preceding the event giving rise to the claim.
• MannVahan is not liable for loss of earnings due to app downtime, low demand, or changes to the fare structure.
• MannVahan is not liable for indirect, incidental, or consequential damages.

17. Indemnification

You agree to indemnify and hold harmless MannVahan, its officers, employees, and partners from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the platform, violation of these Terms, or your actions as a partner driver.

18. Changes to These Terms

We may update these Terms from time to time. We will notify you via the Partner App or email. Continued use of the platform after the effective date of changes constitutes your acceptance of the updated Terms.

19. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of India. All disputes shall be subject to the exclusive jurisdiction of courts in Dhule, Maharashtra.
